Power of Attorney

NYCERS provides two ways by which members can empower a Power of Attorney (POA) to represent their interests and transact with NYCERS on their behalf: 

  1. If you have a power-of-attorney (POA) document drafted by your lawyer, you can submit the signed and notarized original POA to NYCERS for review with a cover letter including your name, address, and mobile number.  If your POA was signed more than one year ago, you must include Affidavit that Power of Attorney is in Full Force Form #203. Upon completed review, NYCERS will return the original documents to you and, if approved, will abide by the stipulations and/or limitations outlined in your POA.  
  2. To establish a power of attorney whose authority is limited only to retirement benefit transactions involving NYCERS, you and your agent(s) can complete Special Durable Power of Attorney Form #204.

Power of Attorney documents and Special Durable Power of Attorney Form #204 can only be submitted to NYCERS by mail or dropped off at the Walk-in Center. Photo and/or digital copies are not accepted.

Special Durable Power of Attorney (POA)

Form #204
A Special Durable Power of Attorney allows you to name one or more agents whose authority is limited to retirement benefit transactions involving NYCERS and does not apply to any other matters. It stipulates a near unlimited authority, granted by you (the principal) to your agent/s, to manage your NYCERS account and make beneficiary changes but allows you to make modifications to limit and/or expand their authority to act on your behalf. For example: By default, your agent(s) can designate non-agents as your beneficiaries, but you can limit their authority and forbid any beneficiary changes or expand it to allow them to designate anyone as beneficiary, including other agents and themselves.

Affidavit That Power of Attorney (POA) is in Full Force

Form #203
Before submitting your Power of Attorney documents to NYCERS, check the date of the principal’s signature. If the principal signed more than one year ago, the agent must complete an Affidavit that Power of Attorney is in Full Force and submit it with the original POA documents.
In some cases, NYCERS may send a written request to the agent/s to reaffirm the validity of a POA that has already been approved to ensure the security of its member’s account.
