Fire Protection Inspector (FPI) 25-Year Plans and Plan Brochures now available
NYCERS has published the Fire Protection Inspector (FPI) 25-Year Plan Brochures #950 and #951 for eligible Tier 4 and Tier 6 FPI Members. An FPI Member is a NYCERS member employed by the City of New York or the New York City Fire Department in a title whose duties are those of an FPI, Associate FPI, or a supervisor of those employees. Log in to your MyNYCERS account to view your eligibility letter and election form.
Cost-of-Living Adjustment (COLA)
The 2024 Cost-of-Living Adjustment rate for eligible retirees and beneficiaries is 1.8%. The annual COLA letter was mailed on September 20, 2024.

Two new laws – Chapter 55 and Chapter 56 of the Laws of 2024 – that were recently passed as part of the New York State Budget, may impact certain NYCERS members and retirees.
New Law:
Chapter 56 of the Laws of 2024 reduces the number of years used in the Final Average Salary (FAS) calculation for certain Tier 3 and Tier 6 members who retire on or after April 20, 2024.

Chapter 56 of the Laws of 2024, effective April 20, 2024, reduces the number of years used in the Final Average Salary (FAS) calculation for certain Tier 3 and Tier 6 members who retire on or after April 20, 2024. If the law applies to you, NYCERS will automatically update your FAS calculation in our system.
Attention Tier 4 and Tier 6 TBTA 20/50 Plan members:
The TBTA has elected by resolution to provide the incentive that removes the age 50 requirement for a Service Retirement.

Attention Tier 4 and Tier 6 TBTA 20/50 Plan members:
Section 1 of Chapter 693 of the Laws of 2023 removes the age requirement for TBTA 20/50 Plan Members. The TBTA has elected by resolution to provide the incentive. Please note:
- The age 50 eligibility requirement for a Service Retirement under this plan has been eliminated.
- Other plan provisions, including the Credited Service requirement, still apply.
- NYCERS will update the Plan documents to reflect this information. No action is required from you now.

Local Law 12 of 2023 requires every New York City agency to create and publish a plan that describes their strategy to address the access needs of people with disabilities. The plan, known as a Five-Year Accessibility Plan, outlines the agency’s accessibility efforts in the areas of Digital Accessibility, Workplace Inclusion, Effective Communication, Physical Accessibility, and Programmatic Access.

Special Accidental Death Benefit (SADB)
Chapter 782 of the Laws of 2022 permits the parents of a member to collect the SADB if the member has no spouse or child under the age of 18 (or 23 if the child is a student).

New Law - Chapter 528 of the Laws of 2022 – Increases certain special accidental death benefits
This law amends the Retirement and Social Security Law (RSSL) § 361-a(c) and General Municipal Law (GML) § 208-f(c) by increasing the deceased member’s salary used in the computation of the special accidental death benefit by adding to it an additional percentage. The beneficiaries of the following NYCERS members are covered: Correction Officers, Housing and Transit Police, Uniformed Sanitation members, certain EMTs and TBTA members.
This law is effective as of July 1, 2022.

In a joint statement, the five New York City retirement systems today announced Marek Tyszkiewicz as New York City’s new Chief Actuary. The Chief Actuary is the legally-designated technical advisor to the five Boards of Trustees, overseeing the actuarial calculations for City employees’ post-employment benefits.

This act amends the provisions of Chapter 77 of the Laws of 2021 and extends the ability for NYC and NYS employees to get 4 (four) hours of paid leave per COVID injection to December 31, 2023.

As of midnight on June 25, 2021, Governor Cuomo lifted the New York State – State of Emergency, and cancelled the Executive Orders written under the State of Emergency.
As a result, NYCERS has returned to its standard policies and procedures as they pertain to the Executive Orders. Read more...
Important Service Announcement
As of midnight on June 25, 2021, Governor Cuomo lifted the New York State – State of Emergency, and cancelled the Executive Orders written under the State of Emergency. As a result, NYCERS has returned to its standard policies and procedures as they pertain to the Executive Orders noted below. Therefore, the following NYCERS Temporary Policies are no longer in effect:
- Open Meetings Law Protocols for Public Meetings
- Notary Protocol
- Allowing 212 Limitations to be Suspended
- Permitting Remote Notarization
- Waiving Notarization on Certain Documents
- Travel Restrictions
The New York City Department of Education did not elect to participate in the ERI by the May 31st deadline.
The City of New York did not elect to participate in the ERI by the June 30th deadline.
Therefore, there is no Early Retirement Incentive for DOE/City employees under Chapter 59 of the Laws of 2021.
2021 Early Retirement Incentive (ERI)
The New York City Department of Education did not elect to participate in the ERI by the May 31st deadline.
The City of New York did not elect to participate in the ERI by the June 30th deadline.
Therefore, there is no Early Retirement Incentive for DOE/City employees under Chapter 59 of the Laws of 2021.
